SOUTH OF 34° JOURNEYS LIMITED
BOOKING TERMS & CONDITIONS
Effective Date: January 6, 2026
These Booking Terms & Conditions (“Terms”) govern all bookings made with South of 34° Journeys Limited (“So34°”, “we”, “us”, “our”) for private luxury Journeys operated in New Zealand and Australia.
By paying a deposit or any portion of the Journey price, you confirm that you have read, understood, and agree to be bound by these Terms on behalf of all persons included in your booking (“Booking Party”).
1. BOOKING CONFIRMATION & AVAILABILITY
All bookings are subject to availability of accommodation, experiences, transport and other suppliers at the time of confirmation.
A booking is not confirmed until:
Written confirmation has been issued by So34°, and
The required deposit has been received within the stated timeframe.
If payment is not received within the required timeframe, availability may be released without notice.
2. MINIMUM GUEST REQUIREMENT (CURRENT POLICY)
As at the effective date of these Terms, So34° operates private Journeys on a minimum of two (2) paying guests per booking.
Single-occupancy or solo travel options are not currently offered under this product structure.
If, at any time prior to departure, the number of confirmed travelling guests falls below two (2), the booking will not proceed and will be treated as a cancellation by the Booking Party.
Applicable cancellation terms will apply.
So34° reserves the right to introduce alternative Journey formats or solo travel products in the future under separate terms.
3. PRICING & CURRENCY
All prices are quoted and payable in United States Dollars (USD).
Pricing is based on:
Supplier rates,
Government charges,
Taxes,
Exchange rates,
And operational costs applicable at the time of quotation.
Prices include applicable New Zealand or Australian taxes unless otherwise stated.
If there is a material increase in supplier costs, government charges, or currency fluctuation prior to final payment, So34° reserves the right to adjust the Journey price accordingly.
No price adjustments will apply once full payment has been received.
Refunds will be processed in USD. Your bank or card provider may apply its own exchange rates or fees.
4. PAYMENT TERMS & SCHEDULE
A. Bookings Made More Than 180 Days Prior to Arrival
5% non-refundable booking deposit due within 5 days of confirmation.
At 180 days prior to arrival: additional 15% payment due within 7 days of invoice.
Remaining 80% due no later than 45 days prior to arrival.
B. Bookings Made 180 Days or Less Prior to Arrival
20% deposit due within 5 days of confirmation.
5% of the total Journey price remains non-refundable.
Remaining balance due no later than 45 days prior to arrival.
General Payment Conditions
Full payment must be received no later than 45 days prior to arrival.
Failure to pay by the due date may result in cancellation and forfeiture of amounts paid.
5. CANCELLATION BY YOU
Cancellation must be received in writing.
Cancellation charges are calculated based on the total Journey price:
60 days or more prior to arrival: Loss of non-refundable deposit (minimum 5%).
59 to 45 days prior: 50% of total Journey price.
44 to 30 days prior: 75% of total Journey price.
29 days or less prior: 100% of total Journey price.
If a booking reduces below two guests, cancellation terms apply.
No refund will be provided for:
Unused services,
Voluntary non-participation,
Late arrival,
Early departure,
Or no-show.
6. MEDICAL EMERGENCY
If a guest cannot travel due to a documented serious medical emergency:
Refund may be provided less:
The 5% non-refundable booking portion, and
Any unrecoverable supplier costs.
Alternatively, funds may be held as credit in accordance with Section 8.
So34° may request supporting medical documentation.
7. DATE CHANGES
Date changes are subject to availability.
Repricing may apply based on new travel dates and seasonal rates.
Supplier change fees may apply.
Requests must be made in writing.
8. TRAVEL CREDIT
Where a credit is issued:
Credit is valid for 12 months from the original arrival date.
Credit is non-transferable unless agreed in writing.
Credit cannot be redeemed for cash.
New travel dates are subject to availability and repricing.
Any increase in price must be paid by the Booking Party.
9. CANCELLATION OR CHANGES BY SOUTH OF 34°
So34° reserves the right to:
Modify itineraries,
Substitute accommodation or experiences of equivalent standard,
Adjust routing due to operational requirements.
If So34° cancels a Journey prior to departure for reasons within our control:
A full refund of amounts paid will be provided.
So34° is not responsible for additional expenses incurred (e.g., international flights, travel insurance, visas).
10. FORCE MAJEURE
Force Majeure includes events beyond reasonable control, including but not limited to:
Natural disasters,
Severe weather,
Pandemic or epidemic,
Government restrictions,
Political unrest,
Industrial action,
Transport disruption.
If a Journey is affected by Force Majeure:
So34° may modify, suspend or cancel services.
Refunds will be provided less unrecoverable supplier costs.
Alternatively, a travel credit may be offered.
So34° is not liable for losses resulting from Force Majeure events.
11. ITINERARY FLEXIBILITY
Itineraries may change due to weather, safety, supplier availability or operational reasons.
Equivalent substitutions may be made.
Such changes do not constitute breach of contract.
No refund is provided for itinerary adjustments beyond our control.
12. TRANSPORT & INCLUSIONS
Transport services are provided as outlined in the confirmed itinerary and “Price Includes” section of your Journey.
Private driver/guide services operate only as specified in your confirmed Journey documentation.
Transport availability does not extend beyond the stated inclusions.
13. TRAVEL INSURANCE
Comprehensive travel insurance is strongly recommended and expected.
Insurance should cover:
Medical expenses,
Emergency evacuation,
Cancellation,
Interruption,
Personal belongings.
Guests travel at their own risk.
14. MEDICAL RESPONSIBILITY
Guests must be in good health and physically capable of participating.
Guests are responsible for:
All medical expenses,
Emergency evacuation costs,
Hospitalisation,
And associated expenses.
So34° may arrange emergency assistance at the guest’s expense if necessary.
15. GUEST CONDUCT
Respectful behaviour is expected at all times.
Illegal drug use is strictly prohibited.
Alcohol consumption must be responsible.
So34° reserves the right to remove any guest whose behaviour:
Poses safety risks,
Disrupts the Journey,
Harms suppliers or other participants.
No refund will be provided in such cases.
Guests are responsible for damage caused to property, vehicles, accommodation or third parties.
16. SUPPLIER RESPONSIBILITY
So34° acts as arranger of services provided by independent third-party suppliers.
Suppliers operate under their own terms and conditions.
So34° is not liable for acts, omissions or negligence of independent suppliers, except as required by law.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, So34°’s total liability arising out of or in connection with a Journey shall not exceed the total amount paid by the Booking Party to So34° for that Journey.
So34° is not liable for indirect, incidental, consequential or special damages.
Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
18. PRICING ERRORS
So34° reserves the right to correct obvious pricing errors.
If a correction results in a price change, you may:
Accept the corrected price, or
Cancel for a full refund of amounts paid.
19. PAYMENT METHODS & CHARGEBACKS
Credit card payments may incur a processing fee as disclosed prior to payment.
Bank transfer fees are the responsibility of the payer.
Initiating an unjustified chargeback after services have been rendered constitutes breach of these Terms.
So34° reserves the right to recover costs associated with disputed chargebacks.
20. PHOTOGRAPHY & MARKETING
During your Journey, So34° may capture photographs or video for marketing purposes.
By participating, you consent to the use of such material unless you notify us in writing prior to travel.

21. PRIVACY
Personal information is collected for the purpose of arranging and delivering your Journey.
Information may be shared with relevant suppliers as necessary.
Our Privacy Policy outlines how your data is collected, stored and used.
22. TRAVEL ADVISOR BOOKINGS
Where a booking is made through a travel advisor, the advisor acts as agent for the Booking Party.
The Booking Party remains bound by these Terms.
So34° is not liable for errors, omissions or miscommunications by third-party advisors.
23. GOVERNING LAW
These Terms are governed by the laws of New Zealand.
Any dispute arising shall be subject to the jurisdiction of the courts of New Zealand.
